8. Trial period, plans, fees, experiments, and invited access
8.1. The Domusync plan refers to the Host and its Host Account. Any access granted to Referred Users is an ancillary feature of the Host's plan and not a standalone service purchased separately by the Referred Users.
8.2. The Host is the only person required to pay the fees for the plan, unless otherwise expressly provided in writing. Referred Users do not accrue, for the sole use of the Service, any independent right to refunds, credits, price reductions, service levels or contractual indemnities.

Participation or eligibility is determined by Domusync based on technical, commercial, or operational criteria, including account status, geography, device, session, or other reasonably relevant parameters.
8.10. The fact that other users receive different offers, prices, features, trials or configurations does not entitle the user to obtain the same or more favorable conditions.
9. Data, content and instructions entered by the user
9.1. You are solely responsible for the data, content, notes, instructions, messages, telephone numbers, emails, automatic texts, names, guest data, configurations and information of any kind entered, imported, transmitted or shared through the Service.

10.2. The Host and the Invited Users access and use such services, links, feeds, data and third-party content at their own risk. Domusync does not control, operate, or maintain such external services and, except as required by law, makes no representations or warranties, and assumes no liability for the availability, continuity, correctness, completeness, timeliness, accuracy, format, compatibility, security, reliability, or persistence of calendars, ICS feeds, content, data, or information from third parties.

10.7. Domusync does not endorse, certify or warrant any third-party services, calendars, feeds, content or providers made available or linkable through the Service. The Host is required to review and comply with the terms and conditions and privacy policy of the relevant third-party provider before using or connecting it to the Service.

14. Intellectual Property
14.1. The software, the Domusync brand, the code, the interfaces, the layouts, the proprietary contents, the documentation, the databases and any other element of the Service are protected by the applicable intellectual property laws and remain the property of the supplier or their respective assignees.
14.2. You are granted a limited, non-exclusive, non-transferable, revocable licence solely to use the Service in accordance with these Terms.
15. Disclaimer of Warranties - Service Provided "As Is"
15.1. The Service is provided on an "as is", "as available" basis and with all errors, defects, limitations, bugs or unavailability.

15.4. You acknowledge that, as with any such software, bugs, delays, synchronization errors, status losses, duplication, temporary inconsistencies, non-delivery of notifications, display errors, or partial or total unavailability of the Service may occur.
15.5. You acknowledge that your use of the Service is at your own organizational, operational and economic risk.

16.2. The provider shall not be liable for damages or consequences resulting in whole or in part from the errors of the user or his team, misconfigurations, inaccurate data, content entered by the user, third-party services, ICS feeds, OTAs, external systems, network delays, unavailability of providers, loss of connectivity, maintenance, security measures, suspensions or force majeure events.
16.3. The supplier shall not be liable to refund the value of lost bookings, overlapping bookings, cancellations, overbookings, underbookings, guest refunds, OTA penalties, re-routing costs, missed cleaning, missed check-in, missed check-outs, organisational costs, personnel costs, loss of profit, reputational damage or other indirect or consequential losses.
16.4. 16.5. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
17. Indemnification of the Host and Users
17.1. The Host agrees to indemnify and hold harmless Domusync, its owners, collaborators, technology suppliers and partners from any claim, demand, action, loss, cost, penalty or expense, including reasonable attorneys' fees, arising out of or in any way connected with: (a) acts, omissions, misconduct, abuse or violation of these Terms by the Referred Users associated with the Host Account; (b) content, instructions, notes, messages, data, documents or information entered, shared or processed by the Host or Invited Users; (c) disputes between Hosts and Invited Users; (d) claims made by Invited Users, contributors, guests, owners, OTAs, or third parties in connection with the use of the Service through the Host Account; (e) lack of legal basis, consent, authorization or legitimacy with respect to the data uploaded or shared by the Host or the Invited Users.

In addition to the foregoing and to the fullest extent permitted by law, each User agrees to indemnify and hold harmless the provider, its collaborators and its technology suppliers from claims, demands, actions, disputes, penalties, costs and expenses arising from violations of these Terms, unlawful use of the Service or violation of the rights of third parties.
18. Suspension, Termination and Changes to the Service
18.1. The supplier may suspend, limit or terminate all or part of the Service, even without notice in urgent cases, for technical, organizational, commercial, security, compliance reasons or in case of violation of these Terms.

19. Privacy and personal data
19.1. The processing of personal data is governed by Domusync's Privacy Policy, to be considered an integral part of these Terms as far as compatible.
19.2. You remain independently responsible for the processing of personal data of third parties that you enter, share or communicate through the Service, including the data of guests, collaborators, invited users and other third parties, to the extent that you act as a controller or subject otherwise required to comply with the law.

21.1. If any provision of these Terms is held to be invalid, void, unlawful or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
21.2. Any failure or delay in exercising a right by the Supplier shall not constitute a waiver of such right or prevent the subsequent exercise of the same.
22. Assignment
22.1. You may not assign, transfer or otherwise dispose of your rights or obligations under these Terms without the prior written consent of the provider.
22.2. You may assign, transfer, award or subcontract all or part of your rights or obligations under these Terms, subject to applicable law.
